Federal contractors across all industries are facing major challenges, including contract suspensions, terminations from DoD and other government directives, rising tariffs, and ongoing labor and material shortages. This session is designed to help you support your clients in navigating these complex issues within the ever-changing federal procurement landscape. We’ll cover essential FAR clauses your clients should understand before bidding on projects, as well as key clauses to negotiate in sole-source contracts. You’ll also gain guidance on how to respond to a government suspension of work notice, and when and how to prepare a Termination for Convenience Settlement package.
In addition, we’ll review FAR clauses that support compensation, required notices to agencies, suppliers, and subcontractors, and clauses that can expose your clients to potential damages and penalties. This includes default clauses, liquidated damages, violations of subcontracting limitations, and more—especially relevant for those struggling with resource shortages and responding to default notices.

This session will cover recent and upcoming federal laws that impact small businesses across multiple areas. Key topics include changes to labor laws, updates to the Buy American Act, the current status of the Corporate Transparency Act, significant FAR language revisions, the new Interim Rule on SAM registration, and evolving procurement regulations. Attendees will also review new solicitation language related to compliance directives, certifications and representations, multiple award contracts, funding availability, and other key clauses raising questions. The session will also explore the SBA’s revised regulations took effect in January 2025, which will impact small business status and the ability to pursue contracts following a merger or acquisition. Topics include updates to mentor-protégé rules, joint venture requirements, past performance policies, and new eligibility criteria for SDVOSB, 8(a), and WOSB certifications. Additionally, the session will provide guidance on the new DBE regulations that became effective in 2024, including major changes to ownership and control standards, UCP reciprocity, and personal net worth thresholds, as well as recent federal affirmative action directives and the evolving DEI landscape.

This presentation introduces a proposed solution to help small businesses overcome cybersecurity challenges in government contracting. Research shows a decline in participation from very small businesses (typically with fewer than 15–20 employees), strongly linked to increasing federal cybersecurity requirements. These policies, initially focused on defense contracts, are expected to extend to non-defense contractors soon. We present “Cybersecurity in a Box”—a simple, affordable, and scalable approach to meeting compliance requirements without overburdening small business resources. Designed with accessibility in mind, this solution empowers small businesses to compete effectively in the federal marketplace. Join us as we explore the development of this project and the impact it could have on the small business community, along with the support it offers to APEX Accelerators guiding businesses through the contracting process.
